Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  • Right of Withdrawal: The period within which the consumer may exercise the right to withdraw from the agreement.

  • Consumer: A natural person not acting in the exercise of a profession or business who enters into a distance contract with a business.

  • Ongoing Agreement: A distance contract for a series of products or services, where obligations are fulfilled over time.

  • Distance Agreement: An agreement concluded between a business and a consumer through remote communication technology.

  • CESOP: Central Electronic System of Payment Information, introduced by the EU to monitor payment service providers.

Article 3 – Scope

These terms and conditions apply to all offers from the business and to every distance agreement concluded. Before an agreement is finalized, these terms will be made available electronically or otherwise.

Article 4 – Offers

Offers are non-binding. The business reserves the right to modify offers at any time. All offers clearly state the total costs, including shipping, customs duties, and any additional postal or courier fees.

Article 5 – Agreement

An agreement is established when the consumer accepts the offer and complies with the stated conditions. The business will confirm acceptance by email without delay.

Article 6 – Right of Withdrawal

The consumer has the right to withdraw from the agreement within 14 days of receiving the product, without stating any reason. Return shipping costs are the responsibility of the consumer when exercising the right of withdrawal.

Article 7 – Costs in Case of Withdrawal

The business will refund the payment within 14 days of withdrawal, provided the product is returned in its original condition.

Article 8 – Customs and Taxes

The customer is solely responsible for fulfilling all legal obligations related to importing goods into the destination country, including but not limited to customs duties, taxes, and clearance fees.

The business is not the official importer of products shipped to customers outside the United States. The customer is responsible for complying with local import regulations for purchased goods.

Any additional costs related to customs clearance, including administrative fees charged by postal or courier services, are the sole responsibility of the customer.

The business provides the necessary shipping documents but does not guarantee that the goods comply with local import regulations. Customers are advised to check import requirements before placing an order.

Article 9 – Compliance with CESOP

As of 2024, payment service providers are required under EU law to record transaction data in the CESOP (Central Electronic System of Payment Information). Businesses comply with this regulation, which may affect the monitoring and reporting of payments.

Article 10 – Compliance and Warranty

The business guarantees that products comply with the agreement and applicable legal requirements. Complaints regarding defects must be submitted in writing within 14 days of receipt. Products must be returned in their original packaging and condition.

Article 11 – Delivery

Unless otherwise agreed, orders will be delivered within 30 days. In case of delays, the business will inform the consumer within 14 days of the order date.

Orders are shipped in such a way that the customer is considered the importer of record and legally responsible for all import-related procedures.

The business ensures products are shipped in accordance with international shipping regulations but is not responsible for delays or issues during customs clearance.

Failure to comply with customs obligations is not a valid reason for order cancellation or refund.

Article 12 – Complaints Procedure

Complaints must be submitted in writing within 7 days of discovering the issue. The business will respond within 14 days. If more time is required, the business will provide an estimated resolution time.

Article 13 – Disputes

These Terms and Conditions are governed by the laws of the United States. Disputes will first be resolved amicably. If necessary, disputes will be submitted to the competent court in Brooklyn, New York, USA.
